Apr 21, 2004 1.) After buying a hot tub that claimed it held 159 gallons of water, I found to my dismay that it held only 158.5 gallons. I returned it and wanted one that held the specified amount of water that the brochure said it held. The salesman couldn’t believe that I was returning it solely for the reason I stated. Look, if it doesn’t hold the amount specified then I consider it false advertisement and fraud. Now, are we going to have a problem? He accepted it and gave me another only after they tested it to make sure it held the amount the brochure specified. 2.) I recently went to the hardware store to buy a lawnmower that specified a 22” cut. But when I measured the blade, it was only 21.8”. I called the store on this and when I left I had a lawnmower with a true 22” blade. 3.) I have a lot of cats and when I went to purchase cat litter, I saw a box that said 21 pounds plus it stated to have 4 pounds free. Getting the product home I found that it weighed only 24 pounds. I weighed the box and it weighed exactly 1 pound. I was furious. I took the litter back to the store and wanted a box that weighed what the box said and not any less. The manager looked at me like I was crazy. But he did open another box and gave me just a little over 1 pound and I left the store happy. 4.) I went to a automobile dealership and had seen an advertisement stating that the vehicle I purchased could go 160 miles per hour. Okay, I went to the straightest road I could find and proceeded to test the speed of the vehicle. It only went up to 145 miles per hour. I took the vehicle back and they refused to take the car back. I sued the company and actually they ended up paying the speeding ticket I received when I tested the vehicle plus they had to give me a car that could go the specified mph. I left with a new car and it didn’t cost me anything. 5.) I bought a measuring cup for $2.50. The lines I guess were wrong. I put exactly 2 cups of water in the thing and to my disappointment it only went to the line below the mark for 2 cups. Needless to say I did return the cup and the manager apologized profusely. He gave me a cup that measured right and I left satisfied. 6.) I was out buying carpeting to replace the old worn out stuff that was in my home. The ad said $12.99 per linear feet. It also stated that the carpet was 12’ wide. When I measured the carpet it was only 11’-11 ½” wide. The manager did figure out the right length and I ended up getting an extra 1 ½” in the length. They didn’t advertise and widths after that. 7.) When I went to buy my house, the ad said that the lot size was 250’ by 129’. I measured the distance and found they were ripping me off of 3 feet one way and 9” the other. I called them on it and told them that they had better reduce the price for the false misrepresentation of the lot size. After they had looked over the details they realized I was right and I got an additional $8,000.00 off the price. 8.) Needless to say I did have to move after being told I was not welcome in any of the local stores anymore. What can I say? I just want things to be specific and when they advertise something, and then it should do what the advertisement claims.
