The Massachusetts Precedent

By Max Burns
May 16, 2004

On Monday, May 17, 2004, the United States of America will become the fourth nation in the world to allow same-sex couples to marry.

On Monday, May 17, 2004, the citizens of Massachusetts, and indeed all of the nation, will rise from their beds, get ready for work and school, and live their lives. The sky will not fall from the heavens; the lakes will not turn to blood and fire; our relatives will not combust.

It will be like any other day to everyone but those same-sex couples in Massachusetts who now have the liberty to marry. The day will be brighter for them, the air fresher, and the water cleaner. They will taste the freedom that, half a century ago, we allowed to blacks when we said that segregation and prejudice would not be government policy.

The majority of Americans 31 and up oppose the idea of same-sex marriage, just as the majority of Americans opposed the idea of blacks being allowed to marry whites. Americans 30 and below are split 50-50 on the issue. It will be those young Americans who choose the policy of our country.

It was not a small, activist court who made the final decision, but the Supreme Court of the United States of America, in denying a delay on the case. The Supreme Court has cleared the path of all obstacles. Midnight this Sunday, the State of Massachusetts will begin accepting marriage certificates from all legal-aged, consenting couples.

Massachusetts has also stood over a 1913 law that forbids granting marriage licenses to couples from out of state. Since it was never applied to heterosexuals, it cannot be applied only to homosexuals. The lawmakers have agreed. This sets up interesting test-cases of same-sex couples returning to states that do not recognize their union and contesting the fact that they are not legally married in that state.

With a swoop of the hand of the Judicial, the walls of Jericho will fall, and the laws of the Bible will no longer overrule the laws of the Constitution and the Courts. Monday, May 17, 2004, the United States will become yet again the model government of freedom and liberty.

The precedent started in Massachusetts has the ability to grant sweeping new rights and protections to same-sex couples. Visitation rights in hospitals, co-insurance on homes, health, dental, and life, co-pay on taxes and marriage benefits granted previously only to same-sex couples.

The laws of religion have stated that woman must remain silent in church, given guidelines to slavery, and said that homosexuality is a sin against God. Today, the laws of the United States have overruled the laws of God and proven the separation of Church and State in the lawmaking process of government.

Free at last, free at last, free at last.
