Aug 30, 2003 The First Amendment to the Constitution reads “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances”. Am I missing something because as I see it the 1st Amendment prohibits Congress from establishing a state religion period! Chief Justice Roy Moore is absolutely correct in his assertion that he has the right as a citizen of the state of Alabama to display the Ten Commandments. In case you haven’t figured it out our entire system of “Western Law” is based on Judeo-Christian concepts. And our Constitution protects our rights to the “free exercise thereof” The current Supreme Court is demonstrating a lack of courage and a total disregard for what the intent of our founding fathers was. Nowhere is the word “separation” found in the above paragraph. In fact for many years up into the 20th century there were state run churches. Why? Because the 1st Amendment prohibits the Federal Government not the individual states. The 10th Amendment is equally clear and to the point. It reads: ”The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people”. This is a State vs. Federal issue and Justice Moore is on the side of the right. I want to say this to all you citizens out there, “ Just because the Supreme Court rules something to be constitutional or unconstitutional doesn’t mean they are right, they make mistakes.” In addition they do not posses the power (Constitutionally) to enforce their rulings and we should defy them when they are wrong. In Louisiana, we had a case in which a federal judge ruled that Louisiana could not put pro life slogan on their license plates. The judge ruled against the State because he said it was not fair to print some slogan and not others. If I were governor I would have told the judge to stuff it! This our state and I would have ordered the Department of Motor Vehicles to continue printing the plates to force the issue. We are the 50 states not the 50 counties of the United States of America. ------------ Email Paul Bernacchio: pbernacchio1@cox.net Comment on this column in the forum.
