Nov. 1, 2004 I have been having a running argument on a political discussion site with a man who claims to be a lawyer and who insists that John Kerry could never be convicted of treason because no one can prove "requisite intent." He claims that giving aid and comfort to the enemy during the Vietnam War doesn't constitute treason since no one can prove that John Kerry INTENDED to give aid and comfort to the North Vietnamese. Nonsense! John Kerry, upon returning to the United States left active duty in the Navy (under what conditions, no one is sure since he's refused to permit us to see his entire military record.) Suffice it to say, that he was placed on "inactive reserve" which STILL makes him subject to the Uniform Code of Military Justice for whatever he does under color of his uniform. We know that John F. Kerry went to Paris, supposedly on his first "honeymoon," and while there met with the North Vietnamese communist and Viet Cong delegation to the Paris "peace" talks. We do not, of course, know for certain what he talked to them about or what he told them, but we do know that when he returned to the United States, he embarked on a public campaign on their behalf to convince the American people to (1) withdraw support from our own government for the war, (2) demand that the United States withdraw unilaterally from Vietnam and (3) pay "reparations" to the North Vietnamese communists. How he did this is a matter of public record. He helped form Vietnam Veterans Against the War (VVAW), with the help of Hanoi Jane Fonda and her erstwhile, and soon-to-be- husband, Tom Hayden, then a leader of the left- wing "Students for Democratic Society" on the University of California at Berkely campus--a long known hotbed of left-leaning causes and campus radicals. He helped organize and testified at the Winter Soldier Project in Detroit and urged at least one fellow veteran to lie about "atrocities" in Vietnam. He then testified before the Senate Fulbright Committee to the effect that the United States, and, by implication, every Vietnam veteran, were all war criminals of the worst sort, guilty of daily tortures, beheadings, rapes and ravaging the countryside like the "Army of Ghengus Khan." Almost all of which were mostly pure lies intended to inflame the passions of Americans against the war--SO THE NORTH VIETNAMESE AND VC COULD BE VICTORIOUS. John Kerry lied about atrocities that he'd "seen" and "committed" himself--again, to discredit his own government and ad propaganda fuel to the anti- war campaign, much of which, we now know, was financed and at least partly directed, from Moscow. Why would a commissioned Naval officer side with communists against his own government? Was it a "youthful flirtation with communism?" One might dismiss what Kerry did as such, EXCEPT for his attitude towards communist governments AFTER he was elected to the Senate. In the mid- 80's, shortly after he'd entered the Senate, John Kerry met with representatives of the communist government of Nicaragua--the Sandinistas, led by Daniel Ortega. He became enamored of these guys, despite the fact that they were carrying on a campaign in Central America to expand Castro's "communist revolution." During that time, Soviet ships off-loaded tons of military equipment and armaments destined for that effort both in Guatamala and El Salvador. Kerry had nothing but praise during this time for Ortega and his crowd--even after Ortega promised a U.S. Congressional delegation that he was NOT a communist and then immediately flew to Moscow, to return with 12 million dollars in aid and promises to supply his efforts to spread the Sandinista and Castro influence to the rest of the region. Kerry helped lead the efforts to close down our aid to the Contras and led the propaganda effort against them--accusing them of being drug runners, operating "death squads" and other, unsubstantiated atrocities. After Ortega returned with that Soviet $12M, many in Congress realized they'd been gulled--both by Ortega AND Kerry and friends--and they restored aid to the Contras thereafter--eventually forcing a free election in which Ortega was sent packing. Kerry's Senate career is notable for one thing and one thing only--he HATED military appropriations and financing anything that would modernize our military services and voted against every single system--most of which were used in both Gulf Wars, in spite of his opposition. He's declared on more than one occasion that the United States should NOT be the sole superpower-- that that distinction belongs to a world goverment--presumably, the United Nations, in whom he places so much stock and to whom he's said he'd delegate responsibility for our national security. If John Kerry gave aid and comfort to the enemy in time of war--and he did--then he committed treason. The "requisite intent" can be inferred by what he DID and it's effects. He helped the North Vietnamese "win" the Vietnam War, subjecting about 15 million SE Asians to lifetimes of hardship and despotism at their hands. In fact, he was so successful at it that the "War Museum" at Ho Chi Minh City (formerly Saigon) Vietnam contains a picture of young Lt. Kerry offering that perjurious testimony before the Fulbrigh Committee and considers him to be a "hero of the revolition." If he's THEIR "hero" he certainly isn't OURS and rightly should be making sand out of big rocks in Leavenworth instead of running for President. ------------ About the author: David A.
