George W. Bush Undermines Clean Air Act

Back in 1970 President Nixon signed into law the federal Clean Air Act. The Clean Air Act created the New Source Review to work along side the EPA. They set forth guidelines for power plants and other industrial facilities to add modern air pollution controls to their smokestacks. (http://dc.indymedia.org)

From George W. Bush's first day in office he worked against the Clean Air Act and the New Source Review by weakening the requirements and exempting thousands of industrial sources and coal fired power plants from this law that are certain to lead to dirtier air. President Bush is the first president in three decades to weaken these federal environmental laws and side with big business. He has taken the control from the states and placed it into his hands allowing for prior violators to use unmonitored discretion of when to apply the law. He has continually been critical of the New Source Review and worked hard to undermine the progress they have made with regard to cleaner air since the laws inception. (http://dc.indymedia.org)

Ed Spitzer, Attorney General for the state of New York, has been a staunch opponent of the Bush Administrations loosening of the Clean Air Act. He said that these lost regulations will lead to acid rain, more smog, more asthma, and more respiratory diseases for all American’s. (http://dc.indymedia.org)

Connecticut Attorney General, Richard Blumenthal, was also critical of the loosening of guidelines set forth in the Clean Air Act by the Bush Administration. He said that it is apparent that they are appeasing the energy industry to the detriment of the people of the Northeast’s right to breathe clean air. (http://dc.indymedia.org)

As of January 2003 nine states have filed law suits against the Bush Administration’s slackening of the Clean Air Act. Maine’s Attorney General, Stephen Rowe, said it was rather “incredible that they had to resort to a law suit to prevent the Bush Administration’s gutting of the Clean Air Act”. Furthermore, he said that it is a sorry state of affairs that the US Government is not looking out for the health of the American citizens, but instead standing up for the corporate financial interests of dirty power plants. Now the courts will determine whether regulators and industry are meeting the requirements of the Clean Air Act. (http://dc.indymedia.org)

This lawsuit challenges the new emission tests, the revised approach for determining baseline emissions, the “clean unit” exclusion, and the plant wide applicability requirements. They are suing because this threatens their streams, rivers, and air quality due to unregulated emissions. They are questioning the rollback of this law without congressional approval and the Administrative Procedure Act, which sets guidelines and processes as to how governmental agencies set forth laws.
