Regime Change Should Begin With The Supreme Court

By Craig Chamberlain
June 29, 2005

Proving once again that they have far too much power the US supreme court said that eminent domain can be used to take property and give it to private developers. So I can only ask when did this become the United Socialist States of America. Apparently the right to property, one of the hallmarks of a free and civil society, is now in constant danger because 5 unelected oligarchs say that it can be taken.

Apparently the 5 justices never bothered to read the 5th amendment. Or in the case of Bader-Ginsburg she most likely looked to European or international law to make her decision, after all American law simply isn't sophisticated enough to govern America, we must have France point out the way. The 5th amendment says that private property shall not be taken for PUBLIC use without just compensation. It says public use, not private. It doesn't say you can tear down a neighborhood you don't like to make way for a shopping center. It also says just compensation. Does anyone really believe that the people that are going to be thrown out of their homes will ever receive just compensation?

This lets a genie out of the bottle and we may never get it back in. Apparently, under the great wisdom of the black robed high priests of the living constitution, a city can now tear down a working class neighborhood by declaring it condemned, sell it to a developer who will build homes for the rich. All in the name of higher tax revenues. This is not the way things are to be done, this is a free country and people should be free in their property unless it was gained illegally.

It should be obvious why the fight over justices is so important. There will be a vacancy on the supreme court soon, and if we're unluck we will end up with another Souter, Gisnburg, or Stephens. And to people that want America to be ruled by unelected judges that is perfectly ok, to those that want the people to actually have a say in the matter we would like a little sanity. Once again the courts have crossed the line, and there is nothing we can do about it.
