In the coming weeks we will get all of that and more as President Bush attempts to find a replacement for retiring justice Sandra Day O'Connor. The left has the courts as their last bastion of power so they will fight any changes to the highest court in the country. They will insist on another O'Connor or Kennedy. The left has four automatic votes on the court, Breyer, Stephens, Bader-Ginsburg, and Souter. They have relied on Kennedy or O'Connor to give them a lot of 5-4 wins. Replacing one of the swing votes with a conservative leaves only one swing vote and could give the conservatives a few key 5-4 victories. This means that it is time for war. The left will pull out all of the stops to destroy whoever the nominee is. Now I could say let's all rise above the partisan fighting. But it has never happened in the history of this country, and being a partisan myself I am loathe to cut any deal or compromise with the left. So I say a conservative needs to be nominated to the court, and the GOP should not give an inch. This can be done in a couple of ways. First, President Bush could make a recess appointment and bypass the whole body of supposed statesmen. The recess appointment has been used before, it was how Thurgood Marshall got onto the court. The appointment will last for one year and with a year on the bench it will be harder to not confirm the nominee. Secondly, but extremely unlikely, is appoint a conservative democrat. Say someone like Ben Nelson. Nelson is more pro life than a lot of Republicans are and it would be interesting to see the democrats shred one of their own party. But this isn't likely to happen. The constitution doesn't say that a nominee has to be a judge or even someone with legal training. A lot of justices were appointed to the court because they were political supporters of the president, it didn't matter whether they had formal legal training. For some reason people think that judges are like computers. All reason weighing the facts with no politcal stances or opinons. Well it doesn't work that way, and since we can't a judge without politcal opinions it is best to get a judge that shares your political opinions. Liberals appoint liberals to the bench and they will be shocked that a conservative would nominate conservatives to the bench.
