Roe v Wade, The Facts

By Ken Hughes
Feb. 21, 2007

My friend Michelle Malsbury said some things in an article today that shouldn’t have been said or should have been clarified regarding the issue of Roe v Wade.

Roe v Wade is perhaps one of the most controversial political issues this nation’s is faced with. There’s certainly room for question on both sides. I take no position either way. Since there’s little chance of my getting pregnant or me getting anyone pregnant it’s of little concern to me. I do however have compassion for the little children who will never have the opportunity to see the light of day.

The young lady from Texas [Norma McCorvey] didn’t file the law suite nor did she instigate the reason for the law suite. Two attorneys Linda Coffee and Sarah Weddington spent years preparing for such a challenge to the abortion laws in Texas. Which by the way were less stringent than many other states?

A companion case Doe v Bolton hadn’t generated the publicity the attorneys were looking for so they set out on a media blitz making sure the word got out “Abortion good, child birth bad.” They received the backing of most Feminist Originations and the case became an over night sensation. District Attorney Henry Wade had his second 15 minutes of fame, his first being the Kennedy assignation.

The case was brought as a violation of the 14th amendment, [Due Process.] However the case was argued as if it violated the Interstate Commerce Act. The justification was women crossed state lines to obtain abortions and therefore became relevant under the commerce laws. It was the only stretch the high court could use to usurp the constitution. The Constitution clearly states those things not directly assigned to the federal government shall be the right of the states to decide, [paraphrased]

The boogieman claiming the right to abortion is based on rape and incest is a bogus argument. Let face it Ms. Malsbury can sugar-coat abortion anyway she likes the truth is 99.99 % of abortions are just another form of birth control. If that’s what people want so be it but let’s not cloud the issue with shady stories of incest and rape, it gives familiy men and rapists a bad name.
