Roe vs. Wade

By Michelle Malsbury
Feb. 19, 2007

The AP reported (February 18, 2007) that McCain is espousing the repeal of Roe vs. Wade if he gets elected president in 2008. President Bush used much the same rhetoric during his term as president, governor of Texas , and prior to his election to elicit the vote of the Christian right. Let me tell you how Roe vs. Wade began, then you decide.

In January of 1973 a single Texas woman tested the rigid Texas abortion laws by bringing a class action lawsuit challenging the constitutionality that prohibited abortions unless it was administered to save the life of the mother. This case was bandied about more than a tennis ball during the US Open, but was finally found to be a violation of the 14th Amendment, Due Process Clause, which provides protections against a state to regulate a woman’s right to privacy which includes the right to terminate her pregnancy during the first trimester. A state cannot override this right. Justice Blackmun rendered this opinion.

While the Christian right may not concur with this decision it should not be their decision to work towards its demise. Rights are just that, privileges afforded equally to all citizens of the United States of America . The Christian right can simply decide not to have an abortion and not worry about abrogating that right for the remainder of the populace, so why take such a hard line stance? The answer is simple, control. This administration and the Christian right are all about control. What ever happened to a person’s right to choose? What of our freedoms granted under the United States Constitution?

The Bush Administration, more than any previous administration, has eroded our personal freedoms to the point of ridiculous! Americans nearly live in a police state. For example, this past weekend I had opportunity to witness a couple of Coast Guard boats docked in our marina in south Florida . These two hard bottom rib boats were equipped with dual machine guns (bow and stern) and each person aboard wore more guns and ammunition in shoulder harnesses and leg straps. I do not know about you, but I can clearly recall the days when the Coast Guard helped stranded mariners and did not have to make a public showing of their armaments. However, those days are gone, eroded away like the sand from the tide. Eroded are our rights to privacy, largely due to the Patriot Act. Instead we see warrantless wiretapping, detaining of people without the right to an attorney or counsel for extended periods of time, and destruction/debilitation of generations of young Americans due to war with an innocent nation.

Let me not stray from my initial intent in this writing and ask if we want other nations and people to become tolerant and work together should not we practice what we preach? Should we curtail a person’s right to choose just because we differ in our opinion of such? I say not! Stand united in the right each of us was given under the Constitution of the United States of America and do not let our government reach for more control by repealing Roe vs. Wade!
