How We Help Bad People

In an opinion piece by Mark L. Earley entitled: “What helps inmates benefits society”, Mark was concerned that a “federal judge in Iowa” ruled that a church program “based on the teachings of Jesus Christ” that was demonstratively helping bad guys be better people was “unconstitutional” and therefore should be “banned”.

Where: “…the judge ruled [the program] “coerced” inmates into “enrolling”; Mr. Earley wrote: “Every single prisoner who testified at trial said that he was not coerced to enrolling in the program.”

Not only that: “Every potential participant is told about the religious aspects of the program. And participants may leave it at any time without penalty.”

So another judge believes he is protecting “society” by eliminating a program that “…offers character education, community service, pre-release training and mentoring by community volunteers on the outside.”

The judge was so concerned that inmates might actually become better people that “…he ordered [the program] refund the $1.5 million it had received from the State of Iowa for services [that were working] rendered – funds that Iowa believes have been well spent and does not want back.”

Judicial activism, especially against a faith that attains results has been documented many times. This case would not be so strange except when bounced against a recent Associated Press report by Darlene Superville entitled: “Most felons have prior convictions”.

The report explaining: “More than half of those convicted of violent felonies in large urban areas between 1990 and 2002 had previous convictions…”

The article was mostly statistics but I thought it was interesting that the stats were a commentary on the period of Clinton appointed judge-ships. Activist judges were appointed based on how nice they could be to bad guys in ensuring the rights of victims became secondary to the rights of all perpetrators.

An accompanying chart entitled: “Repeat Offenders” explained: “More than half those guilty of Murder, rape, robbery, assault or other violent crimes had been arrested for a prior felony.” Stats: 58 percent murder, 40 percent rape, 63 percent robbery, 59 percent assault and 48 percent other violent crime from offenders”, either released early or given light sentences or previously arrested and not convicted or given suspended sentences.

And that is what we do. We end programs pointed at eliminating repeat offenses while we log increases in repeat offenses while suggesting nothing more than lighter sentences, drug treatments or psychotherapy.

The inmates in Iowa testified the program helped them to be better people.

A faithless, activist judge ruled the program must end because he doesn’t know how to interpret the Constitution of the United States and the mandate that explains his personal unconstitutional action in restricting the free exercise of religious practice.

The case is in appeal. Stay tuned.
